1. Introduction

Welcome to FDT Online (the "App"), operated by Fatih Koken ("we," "us," "our"). These Terms of Use ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and Fatih Koken regarding your access to and use of the App on iOS devices, as well as any related websites, platforms, services, features, content, and communications (collectively, the "Services"). By downloading, installing, registering, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree with these Terms, do not use the App. We may update these Terms from time to time, and your continued use of the App after any modifications signifies your acceptance of the revised Terms. Please review them periodically for changes.

2. Eligibility and User Account

2.1 Eligibility Requirements:

You must be at least the age of majority in your jurisdiction or have obtained any necessary parental or guardian consent to use the App. By using the App, you represent and warrant that you meet these eligibility requirements and will comply with all applicable laws, rules, and regulations.

2.2 User Registration:

Certain features of the App may require you to create an account. When creating an account, you agree to:

• Provide accurate, complete, and up-to-date information.
• Maintain and promptly update your account information as necessary.
• Not impersonate any other person or entity, or use a false identity.
• Keep your account login credentials confidential and secure, and immediately notify us of any unauthorized access or breach of security.

2.3 Responsibility for Account Activity:

You are solely responsible for all activities conducted through your account and for ensuring that anyone who accesses the App through your account complies with these Terms.

3. License and Intellectual Property Rights

3.1 Limited License:

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on an iOS device that you own or control, solely for your personal, non-commercial purposes.

3.2 Intellectual Property Ownership:

All content, features, graphics, user interfaces, trademarks, trade names, logos, designs, text, images, audio, video, software, code, interactive features, and other materials contained in or available through the App (collectively, "Content") are owned, controlled, or licensed by or to Fatih Koken. Except for the limited license granted herein, you have no other rights in or to the App or the Content. All intellectual property rights not expressly granted are reserved.

3.3 Restrictions:

You agree not to:

• Copy, reproduce, modify, distribute, publicly display, publicly perform, adapt, translate, or create derivative works from the App or Content without our prior written consent.
• Decompile, reverse engineer, disassemble, or attempt to derive source code from the App or any Content.
• Remove, obscure, or alter any copyright, trademark, or proprietary notices.
• Use any automated system, robot, or scraping tool to access the App for any unauthorized purpose.

4. App Features and Services

The App may include a broad range of features and functionalities, such as:

• Registration and Login
• Gameplay and Virtual Worlds
• Social Features (chat, communities)
• Media and Content Streaming
• E-commerce (in-app purchases, subscriptions)
• User-Generated Content (UGC) features
• Augmented Reality (AR)/Virtual Reality (VR) integrations

We may add, remove, or modify features at any time without prior notice, and we make no guarantee that certain features will always remain available.

5. User Conduct

5.1 Prohibited Activities:

You agree not to use the App in any manner that:

• Violates any applicable laws, regulations, or these Terms.
• Infringes upon the rights of others, including intellectual property, privacy, or publicity rights.
• Is fraudulent, deceptive, harassing, obscene, hate-oriented, defamatory, threatening, harmful, or otherwise objectionable.
• Promotes harassment, bullying, hate speech, threats of violence, sexual content involving non-consenting parties or minors, or discrimination.
• Encourages self-harm or unlawful activities.
• Attempts to gain unauthorized access to the App, servers, networks, data, or other users’ accounts.
• Transmits viruses, malware, or any harmful code.
• Interferes with the operation or security of the App or any third-party networks.

5.2 User-Generated Content (UGC):

Content Standards: If you post, upload, or otherwise transmit UGC through the App, you represent and warrant that you own or have all necessary rights to use and share such content, and that your UGC complies with these Terms and all applicable laws. You must not include or link to any content that:

• Is harassing, bullying, threatening, defamatory, obscene, or hateful.
• Depicts sexual acts involving non-consenting parties or minors.
• Constitutes hate speech, promotes violence, or is discriminatory.
• Encourages self-harm or unlawful activities.

Licensing of UGC: By submitting UGC, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, publicly perform, and publicly display your UGC in any media for any purpose related to the App.

Monitoring and Enforcement: We reserve the right (but have no obligation) to monitor, review, remove, or disable UGC at our sole discretion if we believe it violates these Terms. We may also suspend or terminate your account and/or access to the App if you violate these content standards or engage in prohibited conduct.

6. Virtual Goods and In-App Purchases

6.1 Virtual Goods:

The App may offer virtual goods (e.g., virtual currency, upgrades, digital collectibles) for purchase or as rewards. Virtual goods have no real-world monetary value, are non-transferable (except where allowed), and may expire upon account termination or at our discretion.

6.2 In-App Purchases:

If you make an in-app purchase (e.g., subscriptions, premium content), you agree to the pricing, payment, and billing terms displayed. Payments are processed by third-party payment processors (e.g., Apple App Store), and their terms may apply.

6.3 No Refunds:

Except as required by applicable law, all sales of virtual goods or in-app purchases are final and non-refundable.

7. Third-Party Links and Services

The App may contain links to third-party websites, services, or content not owned or controlled by us. We are not responsible for the availability, accuracy, or content of any third-party sites, nor do we endorse them. Your interactions with such third parties are solely between you and them.

8. Privacy and Data Protection

Your use of the App is subject to our Privacy Policy, which describes how we collect, use, disclose, and protect your personal data. By using the App, you consent to the practices set forth in our Privacy Policy.

9. Security and Data Transmission

We implement security measures to protect your data, but no security is perfect. We cannot guarantee that unauthorized access or breaches will never occur. You acknowledge that you provide data at your own risk. We are not liable for damages arising out of unauthorized access or data breaches.

10. Disclaimer of Warranties

To the maximum extent permitted by law, the App and all Content are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express or implied. We do not warrant that the App will meet your requirements or be error-free.

11. Limitation of Liability

To the fullest extent permitted by law, in no event shall Fatih Koken, its affiliates, or partners be liable for indirect, incidental, consequential, special, or punitive damages (including lost profits or data), arising out of or in connection with the App. In jurisdictions that do not allow exclusion of certain damages, liability shall be limited to the extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Fatih Koken, its affiliates, and their respective employees from all losses, damages, and costs (including attorneys’ fees) arising out of your use of the App, UGC, violation of these Terms, or violation of any law or third-party right.

13. Term and Termination

These Terms remain in effect while you use the App. We may suspend or terminate your access at any time for any reason, including violation of these Terms. Upon termination, your license to use the App ceases, and data or virtual goods may be deleted.

14. Governing Law and Dispute Resolution

These Terms and any disputes shall be governed by Türkiye law, without regard to conflict of law principles. Any claims shall be brought exclusively in the courts located in Türkiye, and you consent to their jurisdiction.

15. Export Controls

You agree to comply with all applicable export laws and regulations. You represent you are not in a restricted country and not on any prohibited lists.

16. Electronic Communications

By using the App, you consent to receive electronic communications from us, including notices about these Terms, your account, and the App’s functionalities.

17. Miscellaneous

Severability: If any provision is held unenforceable, the remaining provisions remain in effect.

No Waiver: Failure to enforce any right is not a waiver of that right.

Assignment: We may assign these Terms without restriction. You may not assign without our consent.

Entire Agreement: These Terms, with the Privacy Policy, constitute the entire agreement between you and Fatih Koken.
